New regulations for environmental compensation related to offshore wind energy are now in effect in the UK.
New legislation designed to speed up offshore wind development while increasing environmental compensation options has been implemented in the UK, the government announced on May 21.

UK Energy Minister Michael Shanks stated, “After two fossil fuel crises in five years, we are advancing more rapidly toward clean, domestically produced energy that we can control, aimed at protecting the British public and permanently reducing bills.” He added, “These reforms will boost offshore wind while ensuring robust protections for our marine environment, enhancing Britain’s energy autonomy.”

As noted by the Department for Environment, Food & Rural Affairs and the Department for Energy Security and Net Zero, the reforms effective May 21 expand the types of compensatory measures available for developers to mitigate unavoidable impacts on protected marine areas.

These updates modify the Conservation of Habitats and Species Regulations 2017 and the Conservation of Offshore Marine Habitats and Species Regulations 2017.

The government indicated that the legislative changes will enable more strategic compensation approaches, such as protecting seabird nesting areas, controlling predators near safeguarded colonies, and restoring native oyster populations.

Accompanying the reforms is new guidance detailing how offshore wind developers should choose and monitor compensatory measures.

It’s beneficial for both nature conservation and the renewable energy sector. We look forward to ongoing collaboration with the Government on the development and execution of offshore wind compensatory measures.”
